We prohibit the use of any content on Roastfe.com that infringes the intellectual property rights of others, including but not limited to copyright, trademark, and related rights.
A. Reporting Intellectual Property Infringement
If you believe that content on Roastfe.com infringes your intellectual property rights, please send a notification of infringement containing the following information to our Designated Agent:
- Identification of the copyrighted work or other intellectual property: Clearly identify the copyrighted work or intellectual property that you claim has been infringed. If applicable, provide the registration number(s) for any such material.
- Identification of the infringing content: Describe the specific content you believe infringes your intellectual property rights, including where it is located on the Roastfe.com website.
- Your contact information: Include your full name, mailing address, telephone number, and email address.
- Statement of good faith belief: State that you have a good faith belief that the use of the copyrighted work or other intellectual property is not authorized by the copyright holder, its agents, or the law.
- Statement of accuracy: Declare under penalty of perjury that the information provided in your notice is accurate and that you are the rights holder or authorized to act on behalf of the rights holder.
- Signature: Provide an electronic or physical signature of the person authorized to act on behalf of the rights holder.
B. Response to Infringement Notifications
Upon receipt of a proper infringement notification, Roastfe.com will:
- Remove or disable access to the allegedly infringing content.
- Notify the member whose content has been removed or disabled.
- Take action against repeat offenders, including removal of infringing content and termination of their account.
C. Counter-Notices
If a member whose content has been removed believes that the content was removed in error or that they have the right to use the content, they can send a counter-notice to our Designated Agent containing the following information:
- Identification of the removed content: Describe the content that was removed and where it appeared on Roastfe.com.
- Statement of good faith belief: Declare under penalty of perjury that you have a good faith belief that the content was removed as a result of a mistake or misidentification.
- Contact information: Include your full name, mailing address, telephone number, and email address.
- Jurisdiction statement: State that you consent to the jurisdiction of the Federal Court for the judicial district in which your address is located, or if your address is outside the USA, for the judicial district in which Roastfe.com is located, and that you will accept service of process from the person who provided notification of the alleged infringement.
- Signature: Provide your electronic or physical signature.
Upon receiving a counter-notice, Roastfe.com may send a copy to the original complaining party and inform them that the removed content may be restored within 10 business days. Unless the rights owner files a legal action, the removed content may be restored within 10 to 14 business days, or more, at Roastfe.com’s discretion.
